Yes, Texas Laws specifically geared towards HOA Associations override the Elliott Ranch documents and should be referred to when an HOA question arises
Chapter 202 of the Texas Property Tax Code specifically applies to enforcement of restrictive covenants, and Chapter 209 governs powers of associations in residential communities.
Chapter 209 is known as the Texas Residential Property Owners Protection Act and establishes standards applicable to records retention, member notices, voting, assessment collection, and foreclosure, among other things.
Check the 209s, then our Elliott Ranch searchable documents. (i.e., roofs, landscaping, rain barrels, solar panels, etc.). Remember the 209s/202s and any other state laws legislated are current and override our Elliott Ranch Documents. All exterior improvements must be approved by the Elliott Ranch ACC except routine maintenance. (i.e. replacing shingles or the .entire roof with similar materials, adding/replacing landscaping previously approved. Please review our DCRs/CCRs webpage, Article 5. Restrictive Covenants.

Our Management Company will regularly drive through the neighborhood, and review complaints that members have filed on the ER website. After review of the Management Company’s proposed violations, as well as those complaints lodged in writing on the ER website, the BODs will determine whether a warning letter should be issued to a member for the correction of the violation prior to a fine. All pertinent information will be referenced in the violation letter from the ER Management Company. It is the BODs intention to help neighbors in any way they can to correct the violation prior to the fine.
This information is private and you should not assume your neighbors have NOT received violation letters and have NOT been fined for a similar infringement.
Section Four of SB 1168 adds a new definition to Section 209.002 for “Verified Mail,” which is defined as any method of mailing for which evidence of mailing is provided by the United States Postal Service or a common carrier. It is not necessary for certified mail to have Return Receipt Requested added to it.

Yes, any exterior improvement must have written approval from the committee (Architectural Committee (ACC). This includes, painting, roofs, additions, outbuildings, fences, pools, etc. The ACC application form can be found on our ER website. Once filled out, the committee (ACC) has 30 days to approve or deny the application.
Yes, we have documents listed on our Elliott Ranch web site. This website will give you information on BOD meeting minutes, financial statements, our ACC improvement application and what is going on in our community. It also has a section where you can fill out a complaint form so that all violations can be verified and addressed by our management company.
Yes, you can notify the management company or a Board member so that you can meet with the Board for a 209 hearing during a special session of either a monthly board meeting or call for a special meeting to address this. The Board will then determine whether to go forth with the violation or suspend the violation.
No, only 3 flags are acceptable, U.S. flag, state flag or military flag. HB680 §202.011. However the HOA can restrict size, and location. Also one flag pole can be erected with approval of the ACC
No, all vehicles need to be either on your driveway or in a garage, The HOA does not allow storage of any type of vehicle on lot such as boat, trailer, yard tractor, etc. except in a garage or storage facility protected from the view of other residents. If you need additional parking space, you need to fill out an application to the ACC for an additional driveway space.
Yes, but you must fill out the ACC application which is located in our ER website and must be approved by the ACC. The 209s are comprehensive and searchable regarding drought improvements to any installation.
Yes, lawns and landscaping need to be maintained along with the culvert that runs along the street. You need to fill out a violation form found on our ER website and the homeowner will need to maintain or otherwise receive a fine.
No, this is against our governing documents and is subject to an immediate fine of $250 if set off on your personal property or $1000 per incident if set off on any common areas including pavilion or surrounding area, green belt or road area. Document record 2010-10000474.
A candidate form will be sent to all homeowners no later than ten days before ballots are due. Any interested homeowner can serve on the BOD, but no two persons from the same primary residence can serve at the same time (this was changed in 2019 Texas legislation). No homeowner can serve who has been charged with a felony within 20 years (this was changed in 2017 SB 1168). Only one vote per lot is allowed. The final vote will be tallied at the annual homeownes' meeting which must be held no later than February of that year. All ballots (electronic, in person or by one other method (absentee, or proxy) will be counted and the candidate will be elected.
Pick up in ER is Wednesdays for Trash and every other Wednesday for Recycle. Trash/recycle receptacles may be placed at curbside no earlier than Tuesday evening and stored away no later than Thursday evening. All trash receptacles must be stored out of view from the street at all times.
